3. The Owner shall not be responsible for any injury, death or damage to property how so ever sustained arisin
g from our Goods under hire.
4. Customers’ needs to provide a valid photo ID at the time of pick up or delivery of our equipment. Nonappearance of the valid photo ID, we have the right to refuse the hand over the items and the Non-Refundable deposit will be confiscate.
5. In the event that the equipment that has been booked becomes unavailable due to damage or theft, J&J Party Hire will offer substitute of the damaged product(s) with a product that is comparable and similar in functionality to the current item(s) hired. If comparable and similar equipment is not available, J&J Party Hire will process a full refund. J&J Party Hire shall not be liable for any loss or damages arising out of our inability to provide equipment due to damage or theft.
6. It is the Hirers responsibility to ensue that the venue is clearly instructed so that the terms and conditions are met.
7. A refundable security deposit is required for all hired Goods, this is held until the return of hired items to The Owner. The deposit is returnable if no loss or damage has occurred to hired items.
8. Shortages and damages to hired goods will be charged at the full replacement cost. No substitute item will be accepted by The Owner.
9. The Owner will inform The Hirer of any damages or missing items concerning any of the hired Goods. An invoice will be sent out lining the amount of damage and costs.
10. Charges will be made for any damaged Goods including Goods that have been dragged on the floor, ground in earth stains, burns, holes, rips and tears, candle wax, grease, mould, mildew, deep staining or broken. This list is not exhaustive, and charges will be made for any permanently damaged or stained Goods.
11. If goods are not returned at the end of the agreed hire period The Owner has the right to charge for the cost of replacement Goods.
12. Cancellation will result in the forfeit of the deposit and any monies paid. Cancellation within 2 weeks prior to the event will incur a loss of 100% of the full amount. In exceptional circumstance The Owner can allow the deposit to be transferred to another date with the same decoration. Transferable deposits are at the Owners discretion
13. We cannot be held responsible for adverse weather conditions, where the event is cancelled due to bad weather on the day of the event the full amount payable is still due. And if the wind is going to be over 30km/h, J&J Party hire have right to cancel the booking due to the safety reasons.
14. We reserve the right to make changes to any Goods in the interests of The Hirer due to adverse weather conditions
15. Payment of booking fees will mean the hirer accepts the terms and conditions as listed.
16. We reserve the right to cancel your booking if payment is not received when due
17. A non-refundable deposit is due when agreement has been made by both parties for the booking. The deposit allows The Owner to keep the date free for your event.
18. The full balance must be paid the day of event. Payments can be made by bank transfer or cash.
19. At time of booking, customers preference timings will be noted and will be logged in our delivery schedule.
20. It is the Hirer's sole responsibility to ensure that the delivery address provided is correct. J&J Party Hire will not be held liable for late or Non delivery due to incorrect address information provided.
21. Unless otherwise agreed to, the hire and delivery fee does not include set-up and/or breakdown. We can provide Set up assistance and pack up after the event, at extra cost, if agreed prior with the customer.
22. It is Hirer's responsibility to secure/ leash the pets for the entire duration of our presence on the property.
23. It is Hirer's responsibility to ensure that the product is suitable for the location of set up and must ensure of the availability of Electricity and Water (If Required). Our equipment come with standard cord lengths of 1.25 metres only and extra power cords are not supplied unless agreed prior.
24. Closer to the hire date, a pre-arranged date and time will be agreed between the Hirer and J&J Party Hire for the delivery and pick-up, or the collection and drop-off, of the hired Equipment in accordance with customers availability and our delivery schedule.
25. Other than as required by law, J&J Party Hire make no representation and give no warranty to the Hirer in relation to the usability or functionality of the Equipment.
26. It is the sole responsibility of the Hirer to ensure that the Equipment hired is suitable for the age and skills of the children who will use it.
27. It is the Hirer's responsibility to examine the Equipment prior to use to determine fitness. If you observe any faults with the equipment, inform us immediately.
28. The Hirer agrees to only use the Equipment for its intended use and in accordance with the Product Information Sheet(s) provided by J&J Party Hire.
29. The Hirer must ensure that all children using any Equipment supplied by J&J Party Hire are always supervised by a competent person.
30. All Equipment supplied on hire remains the property of J&J Party Hire and the Hirer has no legal or equitable interest in the Equipment or any part thereof.
31. The Hirer agrees to keep the Equipment in his/her custody and not to sublease, rent, sell, remove from the delivery address or the address provided on the Hire Agreement form.
32. The Hirer will be responsible for the Equipment until it is collected or returned to J&J Party Hire, and shall maintain the Equipment in good condition, with reasonable wear excepted.
33. In the event of failure of any of our equipment, Hirer must inform us immediately, spares might be available for collection only if the originally hired items are returned to our premises in Brabham, 6055. Spares will only be provided after inspection of original items. If the items have been damaged by misuse, J&J reserves right to refuse supply of any spares.
34. J&J Party Hire shall not be liable for any loss or damages arising out of the misuse, or abuse of the Equipment by the Hirer and the Hirer agrees to keep J&J Party Hire indemnified in respect thereof.
35. In the event of undesirable weather conditions, it is the responsibility of the Hirer to ensure adequate, safe coverage of the Equipment to avoid damage to the Equipment.
36. It is the responsibility of the Hirer to ensure that the Equipment is secure at all times and where being stored in an unlocked premise, supply such security as to ensure its safekeeping.
37. In the event of damage* to the Equipment, the Hirer agrees to pay J&J Party Hire an amount equal to:
a. All costs associated with replacing the Equipment plus a 6% administration fee, or
b. All costs associated with the repair of the Equipment plus a 6% administration fee (if deemed repairable by J&J Party Hire). Damage includes but is not limited to
i. tears/ holes in bouncy castles. Stains left on bouncy castles due to food or face paint. Damage to equipment due to being left in rain or direct sunlight. Damage to the structure of equipment due to incorrect or malicious use.
38. In the event of theft of the Equipment supplied, the Hirer must immediately notify J&J Party Hire, and the Hirer will be responsible for all costs associated with the replacement of the Equipment. J&J Party Hire is under no obligation to provide replacement Equipment.
39. Cancellation terms apply once a booking has been accepted, by accepting the quote provided and having paid the deposit amount for confirming the booking.
40. Cancellations must be made in writing, via Facebook, to J&J Party Hire or contact numbers provided by J&J Party Hire.
41. For cancellations done by the Hirer, the Non-Refundable deposit will be forfeited. If any extra monies have been deposited other than the Non-Refundable fee, the same shall be returned to the Hirer.
42. During periods of severe weather conditions (Storms, high winds, flooding etc), J&J Party Hire reserve the right to cancel a booking. All monies will be refunded in the event of this occurring. J&J Party Hire shall not be liable for any loss or damages arising out of J&J Party Hire's decision to cancel a booking in these circumstances.
43. If the Hirer cancels due to undesirable weather, this will be handled as per cancellation by Hirer and only the Non-refundable deposit will be forfeited by J&J Party Hire.
44. J&J Party Hire are only liable to the Hirer to the extent permitted by law.
45. The Hirer acknowledges and accepts that persons using the Equipment can be injured.
46. J&J Party Hire are not liable to the Hirer or anyone else for any expenditure, injury, loss or damage:
a. arising out of the hire and use of the Equipment,
b. arising from late delivery of the Equipment,
c. arising from an inadequate amount of space for the Equipment to be used safely,
d. arising from the Hirer ordering the incorrect Equipment, or insufficient quantities of the Equipment, or where the Equipment is hired for a purpose which is outside the Equipment's specifications. The Hirer indemnifies J&J Party Hire against any liability to any third party who suffers injury, loss, or damage where such injury, loss or damage is caused wholly or partly as a consequence of any negligent act or omission or other failure on the Hirer's part to ensure the Equipment is used, stored, erected, or transported safely.
47. A responsible adult (18+) must set up and deflate the bouncy and always supervise the castle while in use.
48. Bouncy castle to be set up on a soft level surface at least 1.5 meters from any structure or obstruction such as fence, garage, walls, electrical wires etc. Do not drag the product on cemented or hard surface.
49. Push ground stakes through the loops provided in the bouncy castle base and through blower base holes.
50. The bouncy castle blower must be switched off for at least 10 min after continuous running of 2 hours to avoid overheating.
51. All shoes, glasses, jewellery, sharp objects must be removed before entering the bouncy castle.
52. No food or drinks, chewing gum, face paints, party poppers, coloured streamers or silly string are allowed on the castle.
53. In the event of Rain and/ or heavy winds, it is strongly recommended that the bouncy castle blower be switched off and not used. The blower should immediately be disconnected from power and brought to a covered and dry place. The bouncy castle should be compacted/ folded if required and covered if raining and eventually be brought to covered dry place. Only use the bouncy castle when it is not raining.
54. The blower should be kept away from water and any fire hazards. Ensure that the inflation tube is securely attached to the end of blower (air pump). The inflation tube should be straight and untwisted.
55. Climbing, pulling on or jumping into the walls of the castle is DANGEROUS and is not allowed. No pushing, colliding, fighting or behaving in a manner likely to injure or cause distress to others.
56. Bouncy castle should not be overcrowded as it can cause the bouncy castle to collapse and also result in serious injuries. Limit numbers depending on size and ages of children. Try to group children accordingly.
57. Ensure that no-one with a history of back or neck problems uses the castle or a child who is feeling unwell.
58. If the castle is not being used for any part of the day, please switch the blower off and allow to deflate then simply switch back on to inflate when required. Do not allow anyone to be in or on the bouncy castle during inflation or deflation as this is DANGEROUS.
59. Any wetness, including bubbling (which is normal) can be dried with a towel. In the event that the blower stops working, please ensure all users exit the castle through the main entrance/exit IMMEDIATELY. If the power has been disconnected simply connect it back and switch it back on. If after 5-10 minutes there is still a problem and the blower will not operate, inform us immediately.
60. When deflating, remove the inflation tube from blower and let the bouncy deflate completely. Allow at least 5 minutes. Remove the ground support stakes. Pack up the product in the cover provided.
61. Make sure the bouncy is clean and completely dry before packing/ folding. Stains can be cleaned with a wet towel. The wet option bouncy castles may take up to 2 hours to get completely dry. Drying with Towel/Fabric cloth will help in drying faster. Only dry product must be packed else it can result in mould formation/ bacteria growth.
62. If the bouncy castle has been provided inclusive of set up and pack up option, then Clean up and deflate the bouncy after use. Do not disconnect from the power source. We will inflate the product for inspection and then pack up ourselves.
63. All electrical equipment to be strictly used only for the purpose it is intended for and should not be used in any other way.
64. Only responsible adult should operate the electrical equipment.
65. Bubble machines can result in very slippery surfaces near to the operation of machine. Please make sure that the area is cleaned regularly to avoid slippage/ injury to anyone.
66. If the machine is not working in the manner, it should, please disconnect from power supply and inform us.
67. Follow the individual safety instructions that accompany each item.
68. Clean up the machine/ Equipment after use.
