TERMS & CONDITIONS Please take a moment to read through the following Terms & Conditions. Payment of your deposit indicates your understanding and acceptance of these Terms. COVID- 19 During these uncertain times, Amanda’s Cake Emporium is offering fully refundable deposits along with 'pencilled in' bookings which I recognise and accept may change your original date. As the date of your order app
roaches, we will review the situation regarding confirmation, up or downsizing, postponement and transfer of date and if necessary, a full refund of your deposit. Two weeks notice will be required for refunds and or change of design. PAYMENT A non-refundable* 50% deposit is required to hold your date. If no deposit has been received, your date is not guaranteed and will still be available to other customers. Please be aware that until a deposit is received, your order is not booked in and no cake will be made. Orders that have been fully paid for will be given priority, last minute deposits result in there not being enough time to complete the order. Should Amanda’s Cake Emporium have to cancel at any point due to a problem on my behalf, a full refund will be given on all money paid. A refund or part refund will be considered in special circumstances at my discretion. CANCELLATION/POSTPONEMENT POLICY: If for any reason you need to postpone your event, please contact me immediately. Your new date may or may not be available, I will try to accommodate you wherever possible. If your new date is available, all monies paid will be transferred to the new date without penalty. If the new date is unavailable, please see the below cancellation policy. DELIVERY (where applicable) It is your responsibility to ensure that the venue is open and available for set up at the appointed time. Should I need to wait at the venue to gain entry, you will be billed for the time at the rate of $15 per hour. SERVING SIZES Standard serves are based on a size of 1"x2"x 4"high. Cake serving sizes are estimated. Specialty cakes, carved cakes and method of slicing may affect ultimate serving number. Customer understands and accepts these terms, and must order their products accordingly after having considered these variables. CAKE DESIGN Where a picture has been provided as inspiration for the design, the customer acknowledges that Amanda's Cake Emporium will not produce an identical copy. No two cakes are perfectly alike, even one of Amanda's Cake Emporium's own designs will never be replicated exactly. Amandas Cake Emporium agrees to produce a highly similar cake. Amanda's Cake Emporium makes every effort to create a cake designed to your exact wishes. It is your responsibility to ensure that these are clearly stated and colour swatches, photographs and other design aspects are conveyed accurately. All design aspects must be delivered to Amanda's Cake Emporium no later than 14 working days prior to cake delivery date and time. Although I will attempt to match colours, I cannot guarantee an absolute identical match. Please be aware that some designs are also protected by copyright and therefore cannot be copied. DESIGN CHANGES: The final cake design is due at least two weeks prior to your event date. Any changes made to your original quoted design are subject to a change in price, inclusive of supplies that may no longer be required but have already been purchased. If you find you need more servings, modifications MAY be made to your existing order (depending on the design), or a kitchen cake may be made if availability permits. The modifications/kitchen cake cost and possible fees for the late change must be paid prior to the event date. All changes are subject to availability. ALLERGY INFORMATION
I am able to cater for special dietary needs like gluten/wheat, dairy/lactose and egg free, but I do not offer completely allergen-safe cakes at this time. All of my cakes, fillings, icings and decorations may contain, or have come into contact with, soy, wheat, dairy, nuts, egg, non vegan, non Halal or allergens. Unless specifically requested at the time of ordering, some designs may also include removable items that are of non dietary requests, eg contain gluten or are non vegan. Examples include decoration such as sprinkles, lollies, meringues. I will be extremely careful with my prep and sanitation of equipment and work surfaces, doing my best to make sure no allergen products are in the immediate vicinity on the day I bake for you, However, allergens may still be present. You acknowledge that you are responsible for informing your guests of this allergy information and accordingly, I will not be held liable for any allergic reaction resulting from consumption of my products. FLOWERS, GREENERY AND STRUCTURE :
If you choose to use fresh flowers and/or greenery on or around your cake, I will be happy to purchase, place and arrange them. With some designs, flowers and greenery are your responsibility and should be chosen carefully with your florist, as not all flowers and foliage are safe to place on an edible cake. In both cases, I will not be held responsible for any non-edible flowers or foliage added to your cake. You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants and I am in no way liable for any illness/injury that may occur as a result of using fresh flowers. Please be aware that your cake may have dowling inside to help with structure, this also goes for figurines etc which may contain dowels, skewers, wires or cocktail sticks. DAMAGE: If a third party will be collecting the cake on the customer's behalf, their acceptance of the cake confirms that is received in good condition at the time of pickup/delivery. The best place for your cake to be transported in a car is on the flattest surface such as the floor. Delivered cakes: Once the cake has been delivered and set up, the care and condition of the cake becomes your responsibility. Amanda's Cake Emporium is not liable for any damage that may occur thereafter. Should you choose to have your cake setup outdoors, I am not responsible for what may happen to it, be it weather, insect, child, animal or any other possible cause of damage. Cakes to be picked up: If you choose to pick up your cake, I am not liable for any damages, accidents, or mishaps that may occur once the cake is released from my care. The safest option is to have a passenger hold your cake but if this is not possible, place on the flattest surface of your vehicle, propping up to level if necessary. Buttercream cakes may be stored in the fridge, however I recommend storing covered, at an ambient temperature on the day of serving, or in a cool place if the weather is warm. Fondant covered cakes and other fondant decorations should not be placed in the fridge, please store in a dry area at room temperature. Weather: Humidity and heat can adversely affect your cake. In the warmer months, it is recommended the cake be kept in air conditioning or, at the very least, a cool area. (Please note that refrigeration is not recommended for fondant cakes.) It is strongly recommended that cakes being picked up by the customer be transported in an air-conditioned vehicle. You acknowledge that I am in no way responsible for any damage that may occur due to weather conditions. Repairs: If my services are needed to repair a damaged cake on site, an additional fee will be required (determined based on location and the nature of the damage). Repairs are subject to availability. Exemption: Where damage occurs at the irrefutable fault of Amandas Cake Emporium, a partial or full refund may be given. This will be determined by Amanda's Cake Emporium on an individual basis. Proof must be provided, either in person or by way of pictorial evidence, immediately the damage becomes apparent. The customer is made aware that some designs (eg topsy turvy) are more structurally sensitive than others and improper handling can lead to damage. Assuming all precautions have been taken by Amanda's Cake Emporium to provide sound structural support, no liability will be taken for damage that may occur once the cake is in the customer's possession. UNFORSEEN CIRCUMSTANCES: I will make every effort to have your cake ready in good condition at the specified date and time. I shall not be liable for any delay, damage, or failure to deliver due to circumstances beyond my control. My obligation to perform will be modified to the extent necessary based on transportation problems, power outage, delays in product delivery, inclement weather, illness, acts of God, or any other causes beyond my control that make it impossible or impractical for me to perform. In the event that Amanda's Cake Emporium is unable to fulfill the order, liability is limited to refund / cancellation of any charges due by you and no further compensation will be paid. PHOTOS: Photographs are taken of all cakes Amanda's Cake Emporium creates, and (in the case of weddings) I may purchase copies from your photographer. I reserve the right to use these pictures for my own reference, for display and/or advertising/promotional purposes without compensation to the customer. Thank you
