Workshop on the reinforcement of the operation and administration of CMO, 15th December 2023.

The Copyright Division of MyIPO hosted a workshop with all the Collective Management Organisations (CMOs) declared by the Copyright Controller Malaysia for the strengthening of the operation and administration of the CMO dated 15th December 2023. The full-day workshop was held at Pulse Grande Hotel Putrajaya and attended by MACP, PPM, RPM, MRS, and MRSB from the CMO of the music category, MARC from the literary category, and MPLC from the film category, as well as MyIPO. The aim of the workshop was twofold:

a) To provide an understanding regarding the operation and administration of CMO and as exposure to the MyIPO officers who mainly consist of internal auditors and participants in this workshop covering the background (functions and roles); the types of licensing or activities offered, and the types of rights administered by the CMO on behalf of its members.

b) Briefing from the Copyright Division MyIPO regarding the application procedure for the renewal of the CMO declaration, which will be enforced for the first time under the recent amendment to the Copyright Act 1987.

This was the first time a workshop was organised by MyIPO that gathers all the CMOs in Malaysia in all categories. Besides engagement with all various CMOs in all categories of work, the workshop was informative for the preparation of all CMOs to submit the renewal for the declaration of CMO before the statutory deadline by March 2023. Since it is the first time implementing the renewal, the participants had a fruitful discussion by exchanging views and comments on the relevant form that will be issued by the Controller of Copyright to all CMOs.

PPM, RIM and IFPI Regional Director as well as other music industry stakeholders attended the ‘Bengkel Royalti dan Hak Cipta Industri Muzik’ organised by KPDN with the cooperation of MyIPO which was held from 1 – 3 December at Wyndham Grand Bangsar, Kuala Lumpur. It was a fruitful discussion about the direction of the Malaysian music industry ecosystem through the empowerment of the operation CMO framework.

Here are some examples of works commonly produced by companies that can (and should) be lodged for copyright declaration:

𝟏. 𝐖𝐫𝐢𝐭𝐭𝐞𝐧 𝐖𝐨𝐫𝐤𝐬: This category includes a vast array of content, such as articles, blog posts, books, reports, white papers, manuals, and brochures. If your company produces written content that is unique and original, it can be copyrighted.

𝟐. 𝐒𝐨𝐟𝐭𝐰𝐚𝐫𝐞 𝐚𝐧𝐝 𝐂𝐨𝐦𝐩𝐮𝐭𝐞𝐫 𝐏𝐫𝐨𝐠𝐫𝐚𝐦𝐬: Coding and software are unique creations that can be copyrighted. This extends to the source code, object code, and the user interface.

𝟑. 𝐀𝐫𝐜𝐡𝐢𝐭𝐞𝐜𝐭𝐮𝐫𝐚𝐥 𝐃𝐞𝐬𝐢𝐠𝐧𝐬: If your company is involved in architecture or design, the designs for buildings, homes, and other structures can be copyrighted.

𝟒. 𝐖𝐞𝐛𝐬𝐢𝐭𝐞 𝐚𝐧𝐝 𝐆𝐫𝐚𝐩𝐡𝐢𝐜 𝐃𝐞𝐬𝐢𝐠𝐧𝐬: The unique design elements of a company's website or mobile app, as well as logos, images, infographics, and other graphic designs can be protected under copyright law.

𝟓. 𝐌𝐮𝐬𝐢𝐜 𝐚𝐧𝐝 𝐒𝐨𝐮𝐧𝐝 𝐑𝐞𝐜𝐨𝐫𝐝𝐢𝐧𝐠𝐬: If your company produces original music or sound recordings (for example, a jingle for advertising), these works can be copyrighted. This includes the composition itself and the actual recording.

𝟔. 𝐅𝐢𝐥𝐦 𝐚𝐧𝐝 𝐕𝐢𝐝𝐞𝐨 𝐂𝐨𝐧𝐭𝐞𝐧𝐭: From promotional videos and commercials to documentaries and full-length films, video content is eligible for copyright protection.

𝟕. 𝐌𝐚𝐫𝐤𝐞𝐭𝐢𝐧𝐠 𝐚𝐧𝐝 𝐀𝐝𝐯𝐞𝐫𝐭𝐢𝐬𝐢𝐧𝐠 𝐌𝐚𝐭𝐞𝐫𝐢𝐚𝐥𝐬: This includes creative content used in advertising and marketing campaigns, such as print ads, online banners, radio and TV commercials, and more.

𝟖. 𝐄𝐝𝐮𝐜𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐌𝐚𝐭𝐞𝐫𝐢𝐚𝐥𝐬: If your company develops and sells educational content (e-books, online courses, etc.), these materials can be copyrighted to prevent unauthorized reproduction or distribution.

𝟗. 𝐏𝐡𝐨𝐭𝐨𝐠𝐫𝐚𝐩𝐡𝐬: Professional photographs taken for business use, such as product images, promotional photographs, or other original photographic works, can be copyrighted.

𝟏𝟎. 𝐃𝐚𝐭𝐚𝐛𝐚𝐬𝐞𝐬: In some jurisdictions, a database can be copyrighted if the selection, coordination, or arrangement of the database contents is sufficiently original.

Remember, copyright does not protect ideas, concepts, systems, or methods of doing something. While you can express your ideas in writing or drawings and copyright those, the copyright will only protect the way you have expressed the idea, not the idea itself. For such protection, you might need to investigate other areas of intellectual property law, such as patents.
