"I told the groom I needed a 20-minute break to get something to eat and drink. However, the groom told me that I need to either be the photographer or leave without pay"
Ito ang rant sa social media ng isang wedding photographer matapos pagbawalang kumain ng groom sa reception ng kanilang kasal.
Aniya, nagsimula siyang magtrabaho bilang official photographer alas 11:00 ng umaga na tatagal hanggang alas 7:30 ng gabi.
Pagsapit umano ng alas 5:00 ng hapon ay kumain ang mga bisita kaya nagpaalam ito sa groom na mag 20-minute break muna para uminom ng tubig at makakain.
Ngunit hindi ito pinayagan ng groom at nagbanta pa na hindi babayaran. Kaya sa sobrang inis, nag walk-out nalang ang photographer at para makaganti ay binura din nito ang lahat ng larawan na nakunan sa nasabing okasayon.

DISSENTING OPINION BY JUDGE MARLO CAMPANILLA If the guilty spouse will sell property, must he obtain marital consent from the first spouse and second spouse or either of the two? There are dissenting opinions in this case. With due respect to the majority opinion, i will side with the dissenters. The declaration of nullity of bigamous marriage will be beneficial not only to the guilty spouse, who filed the petition for declaration of nullity of mariage, but also to the offended first spouse, who is not a party to the petition, because it will settle the issues on marital ownership of properties and inheritances. A guilty spouse should be punished under the Revised Penal Code for committing bigamy, but he should not be punished for trying to correct his mistake by filing a petition seeking the declaration of his bigamous marriage as null and void.

The has ruled that only the injured spouse – not the one who knowingly entered a bigamous marriage – can ask the court to nullify it.

In a Decision written by Associate Justice Ricardo R. Rosario, the Supreme Court En Banc denied a Filipina’s petition to declare her second marriage void for being bigamous.

The petitioner first married a Chinese national in Hong Kong and the Philippines. While working in Hong Kong, she had an affair with a Filipino whom she later married when she returned to the Philippines.

Her first husband later obtained a divorce in Hong Kong, which a Parañaque court recognized, effectively dissolving their marriage.

After 14 years, she separated from her second husband and sought to nullify their marriage, arguing that it was void for being bigamous. She also requested permission to remarry.

Denying her petition, the Supreme Court stated that only the aggrieved or innocent spouse from either marriage has the right to petition for the annulment of a second marriage. In this case, it was the petitioner’s first husband who held that right, but he lost it after obtaining a divorce. This right did not transfer to the petitioner, who is considered the guilty spouse.

Tanging ang mga naagrabyadong asawa lang ang maaaring maghain ng petisyon para ipawalang-bisa ang kanilang kasal.

Sa Desisyon na isinulat ni Associate Justice Ricardo R. Rosario, tinanggihan ng ang petisyon ng isang Pilipina na gustong ipadeklarang walang bisa ang kanyang ikalawang kasal dahil sa pagiging bigamous nito. Bigamous ang kasal kapag nauna nang ikinasal ang alinman sa mag-asawa.

Unang ikinasal ang Pilipina sa isang Chinese sa Hong Kong at sa Pilipinas. Pagkauwi ng Pilipinas, ikinasal naman siya sa isang Pilipino na dati niyang naging kliyente sa Hong Kong.

Nakakuha ang kanyang unang asawa ng divorce sa Hong Kong na kinilala ng isang korte sa Parañaque.

Makalipas ang 14 na taon, naghiwalay naman ang Pilipina at ang kanyang Pilipino na asawa. Hiniling ng Pilipina sa korte na ipawalang-bisa ang ikalawang kasal dahil sa pagiging bigamous nito. Gusto rin niyang magpakasal muli. Pero tinanggihan ng Regional Trial Court at ng Court of Appeals ang kanyang petisyon.

Sa desisyon ng Korte Suprema, tanging ang naagrabyado o inosenteng asawa mula sa alinmang kasal ang may karapatang magpetisyon para sa pagpapawalang-bisa ng pangalawang kasal. Sa kasong ito, ang unang asawa ng nagpetisyon ang may hawak ng karapatang iyon, ngunit nawala ito pagkatapos makakuha ng diborsiyo. Ang karapatang ito ay hindi nailipat sa petitioner, na itinuturing na nagkasalang asawa.

Sa ilalim ng Article 35(4) ng Family Code, ang bigamous marriages, o ang mga kasal na pinasok habang ang alinmang partido ay legal na kasal sa iba, ay hindi wasto sa simula. Gayunpaman, ang mga bigamous na kasal ay dapat pa ring ideklarang walang bisa ng korte para sa layunin ng muling pagpapakasal.
