Over the last two weeks, a coordinated effort has been set into motion by those who seek to roll back some of our most important legalization gains, and unfortunately, some “very important people'' are involved. Predictably, this generation’s prohibitionists are recycling the same old claims and scare tactics in their effort to push for re-criminalization.
Our opponents -- aware that they can’t win at the ballot box -- are now seeking to legislatively amend state legalization laws by targeting certain products high in THC for re-criminalization. This legislation is now pending in various states, including Colorado, Florida, and Washington, and, most recently, even Senators Diane Feinstein (D-CA) and John Cornyn (R-TX) have expressed support for these efforts
NORML’s staff and allies have worked diligently in recent days to push back against these efforts and to expose this trope for the age-old scare tactic that it is.
In a new op-ed by NORML’s Deputy Director Paul Armentano, entitled “Just Say No to Arbitrary THC Potency Caps,” he states: “For decades, ma*****na legalization opponents have claimed that the ma*****na of their generation is far more potent, and therefore inherently more dangerous to society, than that of the past. Looking back, it is apparent that each of these previous generation’s claims were little more than pure hyperbole. Nonetheless, these claims had a lasting influence on ma*****na policy — in many cases, leading directly to the passage of detrimental public policies that caused the undue stigmatization and criminalization of millions of citizens. The latest recycling of the ‘It’s not your parents’ pot’ claim is no different.”
In a new message to NORML members in Florida, state Agricultural Commissioner Nikki Fried stresses the urgency of beating back similarly misguided efforts. You can read her message, They’re Politicians, Not Physicians.
These ‘not your parent’s Woodstock w**d’ claims are nothing new. Nonetheless, these sensationalist claims need to be refuted on a regular basis. Otherwise, our opponents’ allegations will go unanswered and gain traction.

NORML is leading the charge against prohibitionists’ latest agenda.
In written testimony to Washington state by NORML’s State Policies Manager Carly Wolf, she states: “Fifteen states regulate adult-use cannabis access; virtually none of these impose [THC cap] restrictions. That is because such a cap is arbitrary and is not in the best interest of consumers who deserve the legal option to access varying strains of cannabis of varying potencies. Imposing such a blanket ban on these higher-potency products will not eliminate demand for said products, but it will succeed in driving this market underground — making it unregulated and unsafe.”
In a nationally syndicated op-ed published today by NORML’s Paul Armentano -- entitled “Is Pot Really More Potent These Days? Does It Matter?” -- he opines: “Consuming too much THC at one time can be temporarily unpleasant. But studies have as of yet failed to identify any independent relationship between cannabis use and mental, physical, or psychiatric illnesses.
Furthermore, THC — regardless of potency or quantity — cannot cause death by lethal overdose. Alcohol, by contrast, is routinely sold in lethal dose quantities. Drinking a handle of vodka could easily kill a person, yet vodka is available in liquor stores throughout the country.
Just as alcohol is available in a variety of potencies, from light beer to hard liquor, so is cannabis. So most users regulate their intake accordingly.”
NORML is also urging concerned citizens in Sen. Feinstein’s and Sen. Cornyn’s districts to contact them directly in opposition to their recent statements. In an email to our members in Texas and California, NORML Political Director Justin Strekal urged NORML members to call these their Senate offices with a simple message: “Their prohibitionist views do not represent us or this nation.” You can read more about our call to action and the Senate report in the coverage by Forbes’ Chris Roberts.
This likely won’t be the last time that we hear these calls to re-criminalize cannabis and to roll-back our hard-fought legislative gains. Nonetheless, we cannot let this latest salvo go without a strong response. Much more work lies ahead in our quest to end the federal prohibition and criminalization of ma*****na, and there will be more bumps like this along the path.
