Over the years many people have thought that common law relationships have the same legal rights as legally married couples. You need to know that every province sets its own parameters for common law relationships. In Ontario there is no provision for division of assets in the breakup of a common law relationship unless both names are on the item. This is true even if both people have been paying towards the house. for example:
The provisions in Ontario's Family Law Act (FLA) that govern the division of property apply only to married couples, not to common-law couples. Each partner in a common-law relationship is therefore entitled only to whatever he or she brought into the relationship or acquired during it.
