TERMS AND CONDITIONS
VIDEOKE RENTAL SERVICE
AGREEMENT
The Diwata VideokExpress (Lessor) lets to the RENTER who RENT from us the equipment described on the face of this agreement on the terms set out on the face of this agreement and here under.
The equipment shall at all times remain the sole property of DIWATA VIDEOKEXPRESS and is never sold.
USE OF EQUIPMENT
You must AWARE of the OPERATING HOURS on your Barangay Ordinance as per in relation to the night time hours limitations. The renter acknowledges that the renter is aware of the purpose for which the equipment was designed for and is aware of all safety procedures required by any lawful authority relating to the use of such equipment and further acknowledges that the equipment is used and operated solely by the renter and that the effectiveness of what the renter intended the equipment to be used for is entirely the renter responsibility. Furthermore no responsibility will be taken for the failure or success of an event where the equipment is used. All planning and correct usage of the equipment is the renter responsibility.
No foreign objects, to be placed on the equipment. The equipment shall not be erected or used near the vicinity of water.
The renter shall take care that access to any; cables or electrical connections are restricted.
The equipment shall be mounted on a flat surface, and out of the vicinity of dangerous objects.
The renter shall provide for electrical equipment a 220volt 15amp dedicated power supply, protected by a working earth leakage system to power the unit.
All hire equipment, unit cables and electrical connections must remain dry at all times
The renter shall under no circumstances attempt to repair, modify or alter any equipment, including units with a cable or electrical connection or any other equipment should it appear that these items are inoperative and in such an event the renter shall contact the lessor for assistance.
The renter shall only use the equipment at the address as it appears on the face of this agreement.
The renter shall exercise due and proper care at all times of the equipment before returning to the lessor.
The renter should, inform the lessor of any damage caused to the equipment on the day of collection.
Any damages caused to any of the equipment listed on the face of this agreement, shall be the full responsibility of the renter to pay for all repairs or total replacement costs of the equipment hired.
OPERATING INSTUCTIONS
The renter acknowledges that the lessor has fully explained the procedure to be adopted in erecting, operating and using the equipment and that the renter knows and fully understands the procedures. No responsibility will be taken for the incorrect usage of the equipment, which could hamper the success of an event or function.
TIMEOUS RETURN
The renter acknowledges that all equipment must be returned in a satisfactory condition by the time specified on the face of this agreement and that failure to return all equipment timeously will result in the lessor being unable to conclude rental agreements with other potential renter for the lease period or periods (as the case may be) commencing after the time specified on the face of this agreement.
The renter agrees to compensate and pay the lessor for any loss of business in the event of the equipment being returned after the specified time as well as if the equipment in a defective or damaged condition, by paying to the lessor an amount which would be recovered over the next lease period or further periods as the case may be.
The lessor reserves the right to recover the cost of all repairs to the equipment.
The lessor reserves the right to recover from the renter, the full current replacement price of any equipment, which may be lost or stolen while in the renter’s possession. Furthermore it is the renter’s responsibility for the safe keeping and safety of the equipment while in their care.
BREACH
If the renter fails to comply with any terms of this agreement the lessor, shall not excluding the remedies which the lessor has in terms of this agreement, have the right to forthwith cancel this agreement and recover possession of the equipment without prejudice to any claim for damages which the lessor may have suffered by reason of the renter’s breach of contract.
PAYMENTS:
Full Payment is required Upon Deliver.
Deposit atleast Half payment for advance RESERVATION.
Payment made via GCASH is accepted.
Payment later is not allowed or “UTANG”
DAMAGES:
If a piece of equipment is accidentally damaged during a rental we have the rights to charge you for repairs or a replacement.
If Any theft and/or disappearance, damage or theft incurred by a third party and damage caused by neglect, abuse, vandalism or misuse of the equipment while in your custody and control. If damaged rental items are not returned, full replacement cost will be charged.
Risk of damage to, or loss of, any VIDEOKE will be passed to you, the Renter, from the time the VIDEOKE are delivered. Please ensure safe keeping of all our equipment from the time within this time.
The cost of any repair to the hire equipment due to damage will be charged to the renter at cost price.

DIWATA VIDEOKEXPRESS cannot be held responsible for any problems occurring from the equipment being moved from original position into unsafe area from thief, rain, fire, etc.
The DIWATA VIDEOKEXPRESS will give instruction the RENTER upon the use of the equipment. It is the responsibility of the RENTER to ask any questions or ask for a repeat demo.
CANCELLATION AND REFUND POLICY
If you cancel more than two weeks before your rental date: full refund less a fee of 10%. Between two weeks and 48 hours before the rental date: you will receive a 50% refund. Less than 48 hours: you will not receive a refund.
If a booking is cancel ahead, and RENTER already done any advance payment deposit or reservation fee is paid this is classed as non returnable in full.
In certain cases, when an event is postponed to a later date, the owner may, at its own discretion, transfer the deposit to the future booking.
No cancellation if the unit is already delivered in your house and already operating.
Refund: If due to unforeseen circumstances your booking is cancelled by us at no fault of your own, we will refund any fees already paid.
DELIVERY:
Delivery Time Although we will do our best to arrive in the desired delivery window, we may sometimes be delayed by circumstances beyond our control (traffic, delays with other deliveries, etc).
Additional delivery charge outside Covered Range Area, or if magbubuhat pa sa malayo. Delivery may delay to some factors like Rainy days, etc.
VIDEOKE RENTAL AGREEMENT
By renting from me you agree to the following:
RENTEE acknowledges receiving all equipment in good operating condition and agrees to maintain such equipment in good condition. If, during the course of the rental, equipment is lost, stolen, or damaged by fire, theft, water, or act of God and any cause whatsoever, whether or not fault of the RENTEE, the RENTEE shall compensate the LESSOR for the full replacement value of the equipment. If the equipment question is no longer replaceable by the same make and model, the RENTEE agrees to compensate the LESSOR for a model equal in value, features, and performance to the lost, stolen, or damaged equipment.
