The State Senate has passed LD 2238

LD 2238 - An Act to Address Gun Violence in Maine by Requiring a Waiting Period for Certain Firearm Purchases(72 Hour Waiting Period)

The three day waiting period seems to be a solution in search of a problem. If it is true that the statistics show only one su***de was committed within 72 hours of a sale year where 114,000 guns were sold , that is truly an infinitesimal percentage. If a three day waiting period is to become law, who will be exempt from the requirement? If a person who holds a State of Maine Concealed Fi****ms Permit, and actually owns one or more fi****ms, should that person have to relinquish possession of those fi****ms for the three days concurrent to the waiting period? If a person who is a hunter, competitive shooter or a person who owns multiple fi****ms for any legal purpose, why should they have to wait to take possession of one more during the waiting period?



This legislation would make it difficult for organizations to promote/conduct a gun show. For example, the Penobscot County Conservation Association conducts an annual gun show where all modern fi****ms sales must be cleared through the Federal National Instant Check System. If a three day waiting period were in effect, the purchaser would need to make arrangements to have the firearm transferred to another federally licensed dealer near the purchasers home, thereby extending the waiting period to possibly a week or longer since the background check is done via the last dealer to process the firearm to the purchaser. Funds generated by the PCCAs Bangor Gun Show help fund scholarships at the University of Maine and Husson University for students in Wildlife Law Enforcement and Wildlife Conservation .This legislation would eliminate the availability of those scholarships.



Essentially this legislation only burdens Maine citizens without measurable benefits.
