As a public service announcement, when being hired or commissioned to photograph events in public places, there have been instances over time where individuals approach me informing me not to include photos of them smoking, drinking, or being at a location they shouldn't be at, as it will be potentially damaging for their reputation, careers, parole eligibility, etc.
Disclaimer: As a photographer, please know that I am not responsible for an individual's reputation, poor choices, or their potential consequences. My primary responsibility is to capture the event as it unfolds. Please understand that I am being compensated or commissioned by a client to photograph an event in public which always takes precedence over a non-paying individual informing me of what photos NOT to take.
Key points:
1. Public place: Since my work is in a public setting, there's no expectation of privacy.
2. Consent: Guests need to understand that photography coverage occurs at a public event.
3. Freedom of the press: As a photographer, I have the right to capture events in a public setting.
However, as a photographer you can also expect this from me:
1. Professional courtesy: I will respect the individual's request, if at all possible.
2. Discretion: I will use judgment when publishing or sharing photos.
3. I will offer to avoid intentional close-ups, but continue capturing the event.
4. I'll be respectful, but I CANNOT guarantee exclusion from all photos.
Something to consider: These days everyone carries a camera phone in their hands. If you are concerned about getting caught in a situation by myself that is potentially damaging to you, you need to be far more concerned about the possibility of getting caught by others. In a nutshell, if you are doing something that you know is wrong and happen to be in a public setting, it is best to either refrain from that activity that is potentially damaging or stay home.
Bottom line: I will always be professional, friendly, understanding, and do my best to meet the needs of every individual.
Real life situation: I was photographing a class reunion at a local bar. A drunk individual, who was not part of the reunion, threatened me of consequences if I post photos of him as he'll lose his job and visitation of his kids. Lucky for me, another person present was a graduating classmate of mine, the sheriff of Scott County.
