Failure to pay rent sure looks like $1,350 in shared expense fees.

When the owners send you so many invoices, you have to ask what is required and isn’t. When they won’t answer! You know it’s a ploy.

This notice is the notice we were eventually evicted on. This $1,350 in shared expense fee, on top of the $5,500 already paid for the month.

There really is no “he said, she said” or back and forth needed. Lies are lies.

I appreciate all of the support everyone. Even more importantly, every small business in the valley needs this. Practice like this needs to stop.

Thank you for the write up!

As details are recorded, and documentation is released, the tendencies of the phoodery to “stretch the truth” and “boldly make things up” will continue to show.

The deeper you dig, the grosser it gets. I implore you all to research.

Phoodery Faces Another Tenant Dispute as Curbside King Challenges Eviction

“We’re not asking anyone to choose sides,” The Phoodery said. “We’re asking that our current businesses be judged by the food they serve, the people behind their counters and the experiences you have with them today.”

To clarify the Phoodery’s false statements.

We paid every dollar of rent(1,900 for the first year. 2,100 at the end of the year), every dollar of cam fees (up to $3400 as agreed on in contract) maxed out through the whole year.

What we were evicted for was an excess on top, supposedly agreed upon by restaurants.
$1,300 total. Our rent/cam paid the same months was $5,500. We absolutely never agreed to pay more that the already outrageous amount.

Check stubs don’t warrant an argument. We were not evicted for rent. The Phoodery wanted us gone, so they created an issue. Owners (Eric and Kyle) would not be clear about what was required vs what was made up completely.

We would have won out in court and beat the eviction.

Kyle personally tried to bribe me with $10,000 to leave quietly. They wanted me to sign another NDA. I refused.

We also were threatened eviction for

1) advertising drinks for another failing business
2) posting a sign saying we couldn’t sell drinks for that business
3) insurance certificate they had already been provided
4) closing down 40 minutes early after selling out one shift.

We gave our 6 month notice, and would have been gone mid December. The Phoodery decided to find a faster way.

Every item listed is %100 true. Factual. Not rumors, not gossip. Facts.

Just so everyone is aware, Al Muelhoefer, Mayor of Phoenix is available for contact on Facebook.

You are able to post, message, and review his antics around the Phoodery.

It’s time he hears what he has enabled.

I have received a few messages essentially requesting that if I don’t have anything nice to say, don’t say it at all.

I’ll stand by the fact that this topic isn’t drama, it isn’t rumors, it’s very real, and more businesses are failing.

Nice guys take the hit, roll with the drama, and move on.

Good men know when it’s time to speak up and stand for something.

Thank you for supporting curbside. I will always be the guy who stands up for what is right. The Phoodery knew that from day 1.

Hey everyone! Update on the Phoodery!

We are not allowed to talk about these issues! I will be sued by the Phoodery for sure! It doesn’t matter..

It costs a small business $5,500-$6,000 to be at the Phoodery. You are sold on a much smaller amount. 3k max. But within the contract they hide clauses that allow maxing these numbers out and doubling down.

Currently 2k for rent, 4k+ in cam fees.

As per usual, the Phoodery has chosen to withhold my $2,500 deposit.

We were evicted over extra cam fees (1300 total) we chose not to be a part of. An additional $500 a month on top of the $5,500. This choice resulted in curbside being left out of all advertising and any group events. They still kept our full rent.

Additionally all donations are forced. The Phoodery forces the restaurants to make weekly donations.

The Phoodery prints out gift certificates for partner restaurants and hands them out unapproved, with no financial pay back. This is a requirement of restaurants. Not contracted, but required.

We will be taking on the Phoodery with full civil action.

The outrageous support from the community makes this all possible. Thank you everyone, truly.
