As every party or special event is a unique project, the price for doing business with Simple Party Designs is not determined by the type of event, but rather by a percentage of the total cost for all products and services being coordinated for your event **. While we'll do all the research and legwork to provide you with a variety of pricing options for each proposed product and service, ultimately the decision is yours on where and how you want to spend your money. And there are no hidden fees or mark-ups to surprise you at the end. Simple Party Designs has a long list of preferred vendor relationships that offer us preferred or discounted pricing- savings that are passed along to you to help you to maximize your budget. 1. Nature of Balloons
Balloons are, by nature, temporary items. Although SPD uses only the finest quality of balloons, some balloons will occasionally deflate sooner than expected. Latex balloons are a natural product and are subject to degradation when subjected to wind, rain, high humidity, rough handling, sunlight, heat and other uncontrollable factors. We NEVER guarantee perfect results with balloon decor, especially when used outdoors. However, we will do everything in our power to make sure the decor will hold up using the BEST quality of balloons and taking extra measures to make them last as long as possible. Color Matching. There are many variables that affect colors in your desired inspiration pictures found online. These are: color difference in digital screens, common photo filters, doubled stuffed custom colors. cool or warm lighting, and minor dye lot differences. Exact balloon color matches are not to be expected. We will make every effort to provide you with your desired color palette. To do so we may need to charge you for ordering special colors that we do not normally stock. We will advise you of those charges in your invoice. You are always welcome to choose from our extensive color selection at no extra cost. Current Industry Shortages. We cannot guarantee product availability. COVID has greatly affected our professional balloon manufacturers and suppliers. We will make every effort to provide you with your desired design and color, however this may on occasion be impossible. We will advise you of the shortage and provide you with alternate styles or colors to suit your desired look.
2. Unexpected Circumstances
Outdoor Contingency Plan: For all outdoor, décor we recommend an indoor contingency plan in the event of rain or inclement weather. We agree to make reasonable accommodations to relocate your décor to your contingency venue the day of your event. In the event of cancellation of services after the balloons have been inflated, there are no refunds issued and no funds transferred to a future event.
1. Acts of Nature (Force Majeure). If SPD cannot provide the services for the event due to acts of nature involving the client, the guidelines under Article 5 pertaining to Cancellation Fee shall take effect. If acts of nature occur to the SPD and consequently SPD is unable to fulfill the contract the Client shall receive a full refund and not be held liable.
3. Safety Warning
Safety Warning: Customer Initials ________________ DO NOT allow anyone to inhale helium from the filling equipment or from balloons! Inhaling helium gas directly from high pressure tank or inflated balloons can cause dizziness, drowsiness, loss of consciousness or other serious injury. Popping balloons can cause eye or other injury. Protective gear, including eye shields, should be worn. Customer is responsible for supervising all use, and preventing all misuse or abuse of helium, balloons, equipment and material related to the event. Latex and micro foil balloons pose no threat to humans, wildlife or the environment WHEN handled responsibly. Broken or uninfected balloons can cause harm to young children and pets and should be disposed of immediately. Children under the age of seven (7) should be under constant adult supervision while playing with latex balloons. Balloons are a choking hazard and Client is responsible for not giving balloons to children three (3) years of age and younger. Our latex balloons are 100% biodegradable, but should not be released. They should be disposed of in a proper trash receptacle. Customer hereby agrees to hold harmless and without liability, SPD and all principals, owners, or employees of said business from any of the following: Helium inhalation or injury from lack of oxygen, slipping on broken balloons, latex allergies, children having access to balloons before, during or after events, children putting balloons in their mouths and choking, eye/facial/body injuries from popping balloons, heart attacks from popping balloons, hearing loss due to popping balloons, lesions, abrasions, suffocation, choking, loss of sight, loss of hearing, dizziness, drowsiness, loss of consciousness, broken body parts, death or any other personal or property damage caused or alleged to have been caused by popping balloons, or damage to swimming pool filtration systems caused by broken balloons.
4. Hardware and Rental Property
All hardware to include rentals, bases, poles, lights, tulle, frames and certain centerpiece bases are the property of SPD. In case of loss or damage to any of the equipment, Client is responsible for the replacement value to SPD. The count and description of said property is listed below. Customer is fully responsible for providing timely access to the event area for strike and Break down. Should all equipment and materials not be available to retrieve from the location, the customer will be responsible for the replacement costs of the missing equipment or material. Products and structures from your job that are property of SPD are listed in your invoice
5. Payments, Fees & Cancellation
If your event is within 30 days of booking, payment is required in full within 2 days of signing the contract. Your event date is not secured until the payment is received. All full payments are non-refundable, but may be transferred to another date within a 12 month period with 6 days notice. If your event is more than 30 days away from booking, a 50% Deposit is due within 2 days of signing the contract. Your event date is not secured until the deposit is received. All deposits are non- refundable, but may be transferred to another date within a 12 month period with 6 days notice. In the event of event cancellation without 6 days notice, client understands there will be no refund.
