For the record Roses Are Red is very much in support of art in public places and we feel that properly permitted murals could add a lot to our little town! We don't feel that it would be that hard to copy the regulations that some of our neighbor towns have. I mean how cute would our store be with a bunch of flowers painted on the wall below our windows by a fabulous local artist??? And who knows maybe murals would help distract from all the road signs on 5th avenue!!! If you're an indialantic resident and you feel the same way, please reach out to your council people and let them know that you want murals reconsidered!!

Town Council will be discussing murals at the upcoming meeting. Murals can add a fun and creative element that often enhance the character of a town. Murals are currently prohibited in our code of ordinances.

Here's the thing, though... the Town Attorney advises that ANY approval process is a cut and dry Constitutional issue as it relates to the 1st Amendment (Freedom of Speech) while a complete prohibition of murals does NOT pose any issues. This means that even a simple permit is a violation, let alone any content moderation/approval. This could potentially open up the Town to a lawsuit or a giant mural of offensive content, for example swastikas or sexual content.

The City of Melbourne (and many cities around the country) has several murals and a permitting with an approval process. Do they know something our attorney doesn't know? Or have they just been lucky and haven't had anyone want to want to cover a wall with a 🐓 and 🏀🏀? Our Town Attorney has 50+ years of experience and HIGHLY respected in government circles. When the wise old owl says it's a Constitutional issue, there is no reason to doubt that and I believe there is case law to support this concern.

So the question is, do we play it safe and keep the current prohibition or roll the dice, allow murals with an approval process, and hope that no one challenges us on it?
