Just a piece of advice for everyone who is in danger of being evicted and think that they have a claim for overpayment of rent. KEEP RECEIPTS AND RECORDS. Just your word in the Justice of the Peace Court is not enough to allow you to keep residing in the rental property - you must provide proof. A Justice of the Peace's hands are tied pertaining to unjustified claims when there is unpaid rent. If the landlord does not want to make concessions and there is no proof that the tenant has overpaid rent or made partial payments, the JP has no choice but to issue the Judgment of Eviction. We cannot give a tenant extra time to find another place to live, make payments or whatever. We are governed by the statutes and the landlord is the one who makes those decisions when there is no proof otherwise.

Finally, if there is also criminal activity or damage to the rental property associated with the eviction proceedings, each one of these reasons is legally a reason to evict.
