Civil Union OR Civil Marriage?
In South Africa, both civil marriages and civil unions are legally recognized, but they differ in their governing laws and inclusivity:
· Civil Marriage: Governed by the Marriage Act of 1961, this is a traditional form of marriage between a man and a woman. It does not accommodate same s*x couples
· Civil Union: Introduced under the Civil Union Act of 2006, this allows any two people, regardless of gender or s*xual orientation, to formalize their relationship. It was specifically created to address the exclusion of same-s*x couples from the Marriage Act.
Legally, both forms of union provide the same rights, protections, and responsibilities. However, the Civil Union Act offers more flexibility, as it allows couples to choose between a marriage or a civil partnership.
I am registered at the Department of Home Affairs to perform Civil Marriages and Civil Union ceremonies.
