NSW TRUSTEE & GUARDIAN Q & A
Applying for guardianship means you are asking for someone to be legally appointed to make health and lifestyle decisions on behalf of another person.
This should be a last resort option because it can be restrictive and impacts on a person’s right to make their own decisions.
The Public Guardian can be appointed as someone’s guardian if there is no one else willing, suitable or able to be appointed. Decisions made by the Public Guardian reflect the principles of the Guardianship Act 1987.
When the Public Guardian is appointed to make decisions in one or more areas of a person’s life on their behalf, they:
• make specific healthcare, lifestyle and medical decisions, including accommodation and living arrangements
• provide or withhold consent to medical and dental treatment
• advocate for care, services and treatment.
The Public Guardian does not make financial decisions for a person under guardianship.
