Ever wondered what happens if someone passes away without a will or trust? In such cases, intestacy laws come into play, determining how their assets will be distributed. Unfortunately, this process can be time-consuming, costly, and may not align with their true wishes.

To protect their inheritance, beneficiaries should take proactive steps. Seeking guidance from an attorney is crucial to understand their legal rights. If disputes arise over asset distribution, beneficiaries can contest the proceedings, but it can be complex and expensive.

One effective way to avoid these complications is by encouraging loved ones to create a will or trust. By doing so, individuals can ensure their assets are distributed smoothly according to their wishes, minimizing disputes.

Let's promote open communication about estate planning to protect legacies effectively. Share this information and empower those around you to take the necessary steps in estate planning.

Estate planning is often misunderstood, leading to confusion and a lack of preparation for the future. Here are some common misconceptions about estate planning and why it's important to overcome them.

Myth: Estate planning is only for the wealthy.
Reality: Estate planning is for everyone, regardless of wealth. It's about making sure your assets are distributed according to your wishes and minimizing the burden on your loved ones.

Myth: Estate planning is only for the elderly.
Reality: Estate planning is important for people of all ages, as accidents and unexpected events can happen at any time. The earlier you start planning, the better prepared you will be.

Myth: Estate planning is a one-time event.
Reality: Estate planning is an ongoing process that requires regular review and updates. As your life circumstances change, so do your estate planning needs.

Myth: I don't need an estate plan because I'm single with no children.
Reality: Estate planning is still important for single people without children. Without a plan, the state will decide who inherits your assets, and it may not align with your wishes.

Myth: I only need a will.
Reality: While a will is an essential part of estate planning, it may not be enough to cover all your needs. Other tools like trusts, power of attorney, and healthcare directives may also be necessary.

Myth: I don't need estate planning because I have joint ownership of all my assets with my spouse.
Reality: Joint ownership can simplify estate distribution, but it may not be enough. If both spouses pass away simultaneously or there are disputes among beneficiaries, a comprehensive estate plan can help avoid conflicts.

By increasing awareness and understanding of estate planning, we can empower more individuals to take control of their future and safeguard their assets.

Setting up a trust is becoming an increasingly popular way for people from all walks of life to safeguard their wealth and safely distribute their assets; both during their lifetime and after they pass away.

Each trust is unique, but there are some common elements / structures that we'd like to share with you.

15/03/2023

A Trust is a legally enforceable arrangement where Trustees look after assets placed in a Trust for the beneficiaries.

One of the main advantages of a Trust is having more control over your assets; as a Will distributes your estate after you pass away, but a Trust can be set up to distribute assets only when certain conditions are met.

To set up a Trust, you need to have a Trust document drawn up & signed by the person creating the Trust (Settlor) and the party appointed to manage the Trust (Trustees). In general, it is possible to set up a functioning Trust in a few days to a couple of weeks.

The following are detailed steps for setting up a Trust:

- Decide on the type of Trust based on your goals.
- Determine which assets go into the Trust.
- Designate your Trustee.
- List the beneficiaries & decide how your estate will be distributed.
- Determine the duration of the Trust & if any factors will result in the termination of the Trust.
- Finalize the details of the Trust & sign the document
- Fund the Trust

If you have questions or want more information on how to get started, we would be happy to offer guidance on your specific situation.
